This is an application for bail in connection with Danapur P.S. Case No. 345 of 2016 registered for the offences punishable under Sections 302, 120B of the Indian Penal Code and 27 of the Arms Act.

Petitioner is named in the FIR and there is allegation against the petitioner and co-accused is of indiscriminate firing on the father-in-law of informant and she is eye-witness to the occurrence.

Submission of learned counsel for the petitioner is that nothing has been recovered from his possession though it is alleged that one pistol of the petitioner and two pistols of other accused persons were recovered from his possession, FSL report

Patna High Court Cr.Misc. No.39681 of 2017 (4) dt.14-09-2017 2/2 shows that they were used weapons, as such, involvement in crime of the petitioner is doubtful. Further submission is that he has falsely been implicated in this case and he is in custody since 22.8.2016 and co-accused person has been granted bail. Heard learned APP and learned counsel for the informant. Learned counsel for the informant has opposed the prayer for bail on the ground that petitioner is named in the FIR and there is allegation against him and he has also made confession on his confession recovery has been made from his house and further prayer for bail of co-accused persons has been rejected by co-ordinate Bench of this Court.

Having heard both sides and in view of facts and circumstances, I am not inclined to grant bail to the petitioner. Prayer for bail is rejected.
