For the Opposite Party : Mr. M. Rab (App) ====================================================== CORAM: HONOURABLE MR. JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 16-09-2015 Heard learned counsel for the petitioners as well as learned counsel for the State.

In this application for anticipatory bail the petitioners apprehend their arrest for the offences punishable under sections 304 (B)/34 of the I.P.C.

The daughter of the informant, namely, Priyanka Kumari was married with Pradeep Singh on 24.05.2014 and due to non fulfillment of demand of dowry by way of Rs. 1,00,000/- and motorcycle she was done to death.

Submission is that the petitioners are old father-in-law and mother-in-law and are living separately from their son.

Patna High Court Cr.Misc. No.22634 of 2015 (3) dt.16-09-2015 2/2 Husband is already in custody. There is no eye witness and further against the petitioners there is no specific allegation. The relations, namely, Ajit Kumar Jaiswal, Amit Kumar and Uday Kumar vide paragraphs 35 to 37 have stated regarding innocence of the petitioners, to which the learned A.P.P. does not oppose. In the facts and circumstances as stated above, the petitioners in case of their arrest or surrender within one month from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of. C.J.M. Vaishali at Hajipur in Hajipur Town P.S. Case No. 51 of 2015, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
