JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-05-2018 Earlier prayer for bail of the petitioner was rejected vide order dated 13.09.2017 passed in Cr. Misc. No. 40113/2017 with a direction to the trial court to expedite the trial and conclude the same within a period of seven months, if not concluded, the petitioner may renew his prayer for bail.

Submission of the learned counsel for the petitioner is that uptill now three witnesses have been examined and there is allegation of assault by Bizar causing injury to the deceased. Only one injury was found on the person of the deceased. Heard the learned Additional P.P. also.

Having heard both sides, in view of the facts and circumstances as stated above, I am not inclined to grant bail to the petitioner at this stage.

No.30350 of 2018 (2) dt.17-05-2018 2/2 However, learned trial court is directed to expedite the trial within a period of six months, if not concluded, the petitioner is at liberty to renew his prayer for bail. With the aforesaid observation, the present petition is dismissed.
