The petitioner seeks regular bail in connection with Nawanagar (Sonversa) P.S. Case No. 198 of 2018 registered for the offence punishable under Section 30(a) of the Bihar Excise (Amendment) Act, 2018.

The allegation is regarding recovery of illicit liquor from the field of co-accused Surendra Singh and also from a truck parked there.

The learned counsel for the petitioner submits that neither any recovery has been made from the petitioner nor the petitioner was apprehended from the spot and he has been falsely implicated in the present case subsequently after his name has surfaced during the course of investigation. It is

Patna High Court CR. MISC. No.14898 of 2019(2) dt.12-03-2019 2/2 further submitted that the petitioner is having a clean antecedent and he is languishing in custody since 13.02.2018. Lastly, it is submitted that similarly situated co-accused person has already been granted bail by a coordinate Bench of this Court by an order dated 13.02.2019 passed in Criminal Misc. No. 8171 of 2019.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II-cum-Special Judge, Excise Act, Buxar in connection with Nawanagar (Sonversa) P.S. Case No. 198 of 2018.
