The petitioner seeks bail in connection with Jadiya P.S. Case No. 137 of 2017 for the offences punishable under Section 379 of the Indian Penal Code.
The allegation is regarding recovery of stolen motorcycle from the petitioner after the police had apprehended him on the road.
The learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case. It is further submitted that the petitioner is having clean antecedent and he is languishing in custody since 11.03.2018.
Patna High Court Cr.Misc. No.30330 of 2018 (2) dt.22-05-2018 2/2 Per contra the learned APP Sri Ashok Kumar has vehemently opposed the prayer for bail.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Suapul in connection with P.S. Case No. 137 of 2017.
