Petitioner seeks bail in connection with Laxamipur (Gidhaur) P.S. Case No. 209 of 2019 registered for the offences punishable under Sections 272, 273 of the I.P.C. and 30(a) of Bihar Prohibition and Excise Amendment Act, 2018. Admittedly, neither petitioner was caught at the spot nor anything was recovered from his conscious possession. The alleged recovery is said to have been made from a room and the local people disclosed the name of the petitioner, who does not have any criminal antecedent which is evident from perusal of para 3 of the petition.

No.13939 of 2020(3) dt.13-05-2020 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 2nd cum Special Judge, Excise Act, Begusarai in connection with Laxamipur (Gidhaur) P.S. Case No. 209 of 2019. However, it is made clear that if the petitioner fails to make available sureties due to lockdown as well as due to prevailing situation, the concerned court shall release the petitioner provisionally on personal bond with condition that petitioner shall furnish the sureties when lockdown is over.
