The petitioner is apprehending his arrest in a case registered under section 302/34 of the Indian Penal Code. According to the first information report the son of the informant went for some domestic work but he did not return and in the night he was found lying in the agriculture field of Shiv Shankar Sahani and thereafter he brought the dead body at his darwaja.

It has been submitted on behalf of the petitioner that petitioner has no criminal antecedent and he is not named in the first information report. Subsequently the informant in course of investigation has named the petitioner. From perusal of the case diary it appears that merely a suspicion has been raised

Patna High Court Cr.Misc. No.23300 of 2015 (3) dt.03-09-2015 2/2 against the petitioner. There is no direct or indirect evidence against the petitioner.

On behalf of the State it is submitted that the petitioner is not named in the first information report. Considering the aforesaid facts, the above named petitioner in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in Hathauri P.S. Case No. 02 of 2013, subject to the conditions as laid down under section 438(2) Cr.P.C.
