The petitioners are apprehending arrest in a case registered for the offences punishable under sections 272, 273 of the Indian Penal Code and 47a of the Excise Act. Prosecution case is that the police raided the embankment of river Dardha in the village Meghaariya and seized 100 litres of illicit liquor, other equipment for manufacturing the liquor and 1200 litres of fermented 'mahua'. It is submitted by learned counsel for the petitioners that only on suspicion the accusation has been levelled. The recovery has been made from the embankment of the river, hence, it cannot be treated from the possession of the petitioners.
Patna High Court Cr.Misc. No.16708 of 2016 (2) dt.19-04-2016 2/2 A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
The aforesaid facts constitute ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Parasbigha P.S. Case No.24/2016, pending before the learned Judicial Magistrate, 1st Class, Jehanabad.
With the above observation, this application is, accordingly, disposed off.
