The petitioner is apprehending his arrest in connection with POCSO Case No.43 of 2017 (arising out of Navanagar P.S.Case No.177 of 2017) , registered for offences punishable under Sections 448, 323, 379, 504, 354/34 of the Indian Penal Code and Sections 8 and 11 of POCSO Act.
Allegation against the petitioner and several other accused persons is of entering inside the house of the informant and trying to outrage the modesty of his daughter and also snatched golden ear ring and chain.
Submission of the learned counsel for the petitioner is that he was not present in village and that has been disclosed by several villagers during the course of investigation and the
Patna High Court CR. MISC. No.15108 of 2019(3) dt.02-05-2019 2/2 police after investigation has also submitted final form against the petitioner but the cognizance has been taken against the petitioner.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Addil. District and Sessions Judge-I-cum-Special Judge, POCSO Act, Buxar in connection with POCSO Case No.43 of 2017 (arisign out of Navanagar P.S.Case No.177 of 2017) subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure. With the aforesaid direction, this application is allowed.
