2. The petitioner seeks regular bail in connection with Vaishali P.S. Case No. 816 of 2025, registered under Sections 103(1), 238, 61(2) and 3(5) of the BNS, 2023.

3. As per the prosecution case, the allegation is that due to a prior dispute, the grandson of the informant, namely, Arjun Thakur, was killed. The deceased was residing in a hostel. The petitioner is alleged to be a cook at the hostel, and the allegation has been levelled against all the staff of the hostel including the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case. It is further submitted that there is no eyewitness to the occurrence and that the case rests entirely on suspicion. The

5. Learned APP for the State vehemently opposes the prayer for bail of the petitioner.

6. Considering the facts and circumstances of the case, this Court notes that the petitioner is a lady, that she has no criminal antecedent, and that she has remained in custody since 17.11.2025 for a period of over six months. The petitioner's alleged role is that of a cook, being one among the members of the hostel staff, and the allegation against her appears to rest on collective suspicion levelled against all hostel staff rather than on any specific overt act attributed to her. Having regard to these factors and the nature of the petitioner's involvement as disclosed in the prosecution case at this stage, this bail application is allowed.

7. Accordingly, let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the learned Court of Sessions Judge, Vaishali, or the concerned court below, in connection with Vaishali P.S. Case No. 816 of 2025.
