The petitioner seeks bail in Turkaulia P.S. Case No. 183 of 2018, G.R. Case No.1700 of 2018, registered under Section 147, 148, 149, 323,341,342,332,307, 224, 225, 504, 506, 353, 379 and 427 of the Indian Penal Code.
Petitioner and one another accused Sharma Patel apprehended along with country made liquor and were lodged in Hazat and in order to get them released from the Hazat several accused persons descended at the police station and assaulted the police personnel, damaged the vehicle parked therein and other articles.
It is submitted by learned counsel for the petitioner that the
Patna High Court Cr.Misc. No.30433 of 2018 (2) dt.23-05-2018 2/2 petitioner is quite innocent. He has no concern with the aforesaid occurrence. Admittedly, he was in the Hazat at the time of occurrence in connection with a case relating to the seizure of country made liquor for which a case was lodged against him being Turkaulia P.S. Case No. 180 of 2018 and petitioner has been enlarged on bail by the learned lower Court in this case. Petitioner has no criminal antecedent except the aforesaid one. The petitioner has been languishing in custody since 09.04.2018. It is further submitted that the co-accused person has already been granted bail by an order dated 21.05.2018 passed in Cr. Misc. No. 31365 of 2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Turkauliya P.S.
