Parmanand Prasad, APP for the State.

The petitioner herein seeks anticipatory bail in Tharthari P.S. Case No. 24 of 2016, registered under Sections 302, 328/34 of the Indian Penal Code.

The informant has alleged that his daughter was married to co-accused Bijram Pandit (Devar of the petitioner) two years ago. A few days before the incident, there was scuffle in the family. It was informed that his daughter was done to death by these two co-accused persons including the petitioner. When the informant reached his daughter Sasural both of them had absconded.

Patna High Court Cr.Misc. No.17386 of 2016 (2) dt.09-05-2016 2/2 It is submitted that the petitioner is a widow and lives separately. It is only the suspicion raised in the First Informant Report.

Learned APP opposed the prayer and submitted that it is a serious offence inasmuch as in course of investigation, the witnesses have supported the prosecution case. The cause of death is asphyxia.

Considering the seriousness of the allegations and other materials reflected from the impugned order, I am not persuaded to extend the privilege of anticipatory bail. The prayer is rejected.
