The petitioner is languishing in custody for the offence punishable under Sections 30(a) 38(1) of the Bihar Prohibition and Excise Act, 2016.
Submission is that recovery of liquor is alleged from the field side and not from the physical possession of the petitioner or from the house of the petitioner. Petitioner has got no criminal antecedent. Petitioner is in custody since 10.02.2020.
Considering the entire facts aforesaid, let the petitioner, above named, be released on bail , on furnishing bail bond of Rs. 20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Second
