JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-06-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under section 366A of the Indian Penal Code.

The accusation is of kidnapping the minor daughter of the informant. In 164 Cr.P.C. statement the victim has alleged that she was ravished by the petitioner. It is not in dispute that the victim is minor.

It is submitted by learned counsel for the petitioner that the petitioner is also minor and they were in love from before. This court is not inclined to accede to the prayer of the petitioner in the present proceeding. However, let the learned court below consider the prayer for regular bail of the

Patna High Court Cr.Misc. No.23335 of 2015 (2) dt.25-06-2015 2/2 petitioner in case the petitioner surrenders within six weeks from today or if so advised the petitioner may take resort to the provision of the Juvenile Justice (Care and Protection of Children) Act in connection with Khaira P.S. Case No. 36 of 2015 pending in the court of learned J.M. Ist Class, Jamui. This application is disposed of with the aforesaid observation/direction.
