JUSTICE RAKESH KUMAR ORAL ORDER 19-08-2017 Heard Sri Raj Kumar Sinha, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 04-07-2017 in Begusarai Muffasil P.S. Case No. 298 of 2017 registered for offence under Section 414 of the Indian Penal Code and Section 30(A) of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail.

By way of referring to statement made in paragraph - 3 of the petition, it was submitted by learned counsel for the petitioner that petitioner is having clean antecedent and has falsely been apprehended on an allegation that he was on driving sit of Maruti Swift Car, from which vehicle, huge quantity of about 26 litre of Indian make foreign liquor was recovered. Learned counsel for the petitioner submits that one of the co-accused, who was

Patna High Court Cr.Misc. No.39680 of 2017 (2) dt.19-08-2017 2/2 similarly arrested, has already been granted bail by this Court. Considering the nature of accusation, clean antecedent as well as fat that co-accused has been granted bail, there is no reason to further detain the petitioner.

Let the petitioner namely Nawin Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Anil Kumar Sinha, learned 7th Additional Sessions Judge cum Special Judge, Begusarai in connection with Begusarai (Muffasil) P.S. Case No. 298 of 2017.
