====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 14-03-2024 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State.
2. The petitioner seeks regular bail in connection with Bhabua P.S. Case No. 407/2023 lodged on 16.05.2023 under Section 304B/34 of the Indian Penal Code.
3. As per the prosecution case, the FIR has been lodged against five named accused persons, including the present petitioner. The accusation is of killing the daughter of the informant for non-fulfillment of the dowry demand.
4. Learned counsel for the petitioner submits that the petitioner being the mother-in-law of the victim and 50 years of age is innocent and has committed no offence. The husband of the deceased is already in judicial custody and a statement to
Patna High Court CR. MISC. No.17502 of 2024(2) dt.14-03-2024 2/2 that effect has been made in paragraph 16 of the bail petition. The allegation against the petitioner is omnibus and general. The petitioner is in custody since 09.01.2024 having no criminal antecedent.
5. Learned counsel for the State opposes the prayer for bail.
6. Learned counsel for the informant vehemently opposes the prayer for bail and submits that since there is involvement of the petitioner in the commission of the said crime, hence, before considering the prayer for bail of the petitioner, the case diary may be called for.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Kaimur at Bhabua, subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure.
