The petitioner seeks regular bail in connection with Makhdumpur (Tehta O.P.) P.S. Case No. 122 of 2017 registered for the offences punishable under Sections 147, 148, 353, 307, 414 of the Indian Penal Code and Section 27 of the Arms Act. Allegation as per First Information Report is that the petitioner along with 5 other accused persons came at the village of Tin Mohana in which one of them namely, Karu Yadav has fired on the informant and threatened to kill him. The informant is said to be the driver of the vehicle.
Submission of learned counsel for the petitioner is that there is general and omnibus allegation against the petitioner. The petitioner is accused in two cases; one is Kako P.S. Case No. 69 of 2008 and another is Makhdumpur P.S. Case No. 326 of 2015
Patna High Court Cr.Misc. No.46241 of 2017 (2) dt.19-09-2017 2/2 and he is on bail on both the cases. It has further been submitted that petitioner is in custody since 16.08.2017. Heard learned A.P.P. also.
In view of the facts and circumstances of the case, this application is disposed of with a direction to the learned court below that once charge sheet has been submitted against the petitioner in this case, he will verify the materials available on the record and if there is no allegation of firing against him, he will release the petitioner on bail to his own satisfaction.
