The petitioner seeks regular bail in connection with Durauda P.S. Case No. 113 of 2017, for the offences punishable under Section 272, 273, 308 and Section 30, 38 of the Bihar Prohibition & Excise Act, 2016.

The allegation is regarding recovery of 136 liters of illicit liquor from a PACS Godown.

The learned counsel for the petitioner submits that neither any recovery has been made from the conscious possession of the petitioner nor the said PACS Godown belongs to the petitioner. It is further submitted that the petitioner is languishing in custody since 24.4.2018.

Having regard to the facts and circumstances of the

Patna High Court Cr.Misc. No.31105 of 2018 (2) dt.23-05-2018 2/2 case, the petitioner, above named, is directed to be released on bail, on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-cum- Special Judge, Excise, Siwan in connection with Durauda P.S. Case No. 113 of 2017 as well as G.R. No.3186 of 2017.
