====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 17-05-2023 The present application has been filed for restoration of Civil Misc. No. 868 of 2022 which got dismissed for default for non-compliance of the order dated 22.12.2022 passed by this Court.

Learned counsel for the petitioner submits that by mistake the requisites for issuance of notice was furnished for respondent No. 1 only, but now, the requisites for issuance of notice upon respondent No. 2 also has been filed on 9.5.2023. If that be so, the present restoration application is allowed and Civil Misc. No.868 of 2022 is restored to its original file.

Patna High Court MJC No.654 of 2023(3) dt.17-05-2023 2/2 Office is directed to verify as to whether the requisites for issuance of notice upon both the respondents have been filed by the petitioner and if the same has been filed, the office is further directed to take steps for issuance of notice upon both the respondents.
