Complainant got settlement with respect to certain area of the land in terms of BPPHST Act and remaining areas of the said plot assorted to the landholder was there for which negotiation was finalized on a certain consideration amount which, he used to pay by way of having been employed at their end. Subsequently thereof, when they have gone to have sale deed executed, registered, the complainant smacked foul play whereupon instant case has been filed. It is also evident from the complaint petition that petitioner Bhudeo Choudhary had already executed sale deed on 13.03.2013 in favour of other coaccused.
Patna High Court Cr.Misc. No.12281 of 2015 (2) dt.06-05-2015 Taking into account the nature of dispute over mode of acquisition, prayer of petitioners are found appreciable whereupon petitioners Bhudeo Chaudhary, Akhilesh Kumar Chaudhary each are directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) each with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Complaint Case no.522 of 2013 in the event of their arrest / surrender within four weeks in terms of condition so laid down under Section 438(2) Cr.P.C.
