JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-04-2016 Heard learned counsels for the petitioner and the State. The petitioner being PDS dealer is apprehending arrest in a case registered for the offences punishable under Section 7 of the E.C. Act.

The prosecution case is that the petitioner used to supply essential commodities to the consumers by charging excess price. It is submitted by the learned counsel for the petitioner that during enquiry the consumers have stated that neither excess price was being charged nor there was any irregularity in distribution of foodgrains. Enquiry report is the part of the FIR. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named

No.18230 of 2016 (2) dt.27-04-2016 2/2 petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Khagaria in connection with Maheshkhunt P.S. Case No. 17 of 2016 subject to the conditions as laid down under Section 438(2) Cr.P.C.
