Mr.Ajit Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 05-07-2019 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

Petitioner apprehends his arrest in connection with Complaint Case No.1108C/2016 for the offence punishable under Section 498(A) of the Indian Penal Code. The allegation against the petitioner in the complaint case is that the marriage of the petitioner was solemnized with opposite party No.2 nine years ago and after the marriage, the petitioner used to abuse and torture the complainant on nonfulfillment of demand of dowry of Rs. 5 lakhs. Learned counsel for the petitioner submits that this Court was pleased to issue notice to opposite party No.2 but despite service of notice, no body appeared on behalf of opposite party No.2.

Patna High Court CR. MISC. No.15000 of 2019(6) dt.05-07-2019 2/2 Learned counsel for the petitioner further submits that the allegation of torture for dowry is completely false and fabricated and all the family members of the petitioner has been made accused by the complainant.

After having heard learned counsel for the petitioner as well as learned counsel appearing on behalf of the State and taking into consideration the fact that despite service of notice, nobody appeared on behalf of opposite party No.2, accordingly, the petitioner, above named, is directed to surrender before the learned Court below within a period of four weeks and in the event of surrender by the petitioner, the petitioner shall be released on anticipatory bail by the Court below upon furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J., 2nd, Jamui, subject to the condition as mentioned under Section 438

(2) of Cr.P.C.
