This is an application for bail in connection with Saur Bazar P.S. Case No. 158 of 2017 registered for the offences punishable under Section 392 of the Indian Penal Code. Petitioner is not named in the FIR and the case is under Section 392 IPC. It appears that during course of investigation in the confessional statement of co-accused name of petitioner transpires.
Submission of learned counsel for the petitioner is that except confessional statement there is nothing against him and confessional statement has been made in connection with Saharsa P.S.Case No. 399 of 2017 and thereafter he has been remanded in this case and thereafter one after another cases have been filed
Patna High Court Cr.Misc. No.44149 of 2017 (3) dt.17-10-2017 2/3 against him. Further submission is that he is in custody since 15.6.2017 and co-accused has been granted bail by co-ordinate Bench of this Court in Cr.Misc.No. 41382 of 2017, vide order dated 21.9.2017.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa, in connection with Saur Bazar P.S. Case No. 158 of 2017, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties in the jurisdiction of court concerned, (2) Petitioner shall mark his attendance in local police station in first week of every month till conclusion of trial or at least for a period of one year, whichever is earlier, so that police may watch his conduct during that period, failing which his bail bond shall be cancelled.
