JUSTICE SUDHIR SINGH ORAL ORDER 13-07-2015 The petitioner is apprehending his arrest in connection with Jogbani P.S. Case No. 44 of 2012 for the offences instituted under Sections 420/34 of the I.P.C. and 18( c), 27(B) (II) of the Drugs and Cosmetic Act.
Heard learned counsel for the petitioner and learned counsel for the State.
The prosecution story, in brief, is that on 20.06.2012 on getting information the informant who is Drug Inspector, went to Ward No. 10 Tikulia Basti, Jogbani and found illegal stock and selling from the house of Ram Prayesh Sah and also found four Nepalee citizen in consuming intoxicated medicine. The informant has also found the illegal stock in the house of Ram Lal Yadav, the petitioner and one Sunita Devi and he seized the same and the
Patna High Court Cr.Misc. No.22221 of 2015 (2) dt.13-07-2015 2/2 seizure lists were prepared and the raiding report and seizure lists are on separate sheet, enclosed.
It has been submitted on behalf of the petitioner that the petitioners has been made accused due to mistake of fact as to when whatever medicine that is being alleged to have been recovered worth Rs. 5,000/-. Further it is submitted that the petitioner has got no criminal antecedent.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Jogbani P.S. Case No. 44 of 2012(G.R. No. 1347/2012) on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Araria, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
