Petitioner seeks bail in a case registered for the offences punishable under Section 302 and other allied sections of the Indian Penal Code.

Earlier the prayer for bail of the petitioner was twice rejected on merit and again the bail of the petitioner is sought on the ground of his incarceration. However, the trial court has reported that prosecution has already closed its evidence and the case is pending for defence evidence and argument. It appears that the trial of the petitioner is on the verge of conclusion.

No.39859 of 2017 (3) dt.13-09-2017 2/2 Accordingly, again I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Sessions Trial No. 03 of 2015 arising out of Barharia, (G.B. Nagar) P.S. Case No. 304 of 2014 pending in the court of Additional Sessions Judge-III, Siwan stands rejected. However, learned trial court must conclude the trial of the petitioner within two months from the date of receipt/production of copy of this order, failing which the matter shall be viewed seriously.
