2.The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Baikunthpur P.S. Case No. 429 of 2024 instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Amendment Act.

3. The case of the prosecution is that the petitioner along with others was suspected of having liquor. In course of search near the hut of one Dinesh Singh from a sugarcane field, recovery of 240 liters of illicit liquor was made.

4. Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.15306 of 2025(2) dt.21-04-2025 2/3 petitioner has submitted that petitioner is innocent and has committed no offence. He has falsely been implicated in this case. It has further been submitted that his name has surfaced only on the basis of information to the police. Nothing has been recovered the possession of this petitioner. Recovery has been made from a sugarcane field near the hut of one Dinesh Singh. It has also been submitted that co-accused Bhagwan Rai has been granted anticipatory bail by learned Co-ordinate Bench of this vide order dated 16.04.2025 in Cr. Misc. No. 15874 of 2025 and the case of this petitioner stands on similar footing. 5.Learned APP appearing for the State has opposed the prayer of bail of the petitioner and submitted that petitioner is having two criminal antecedents of similar nature.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Baikunthpur P.S. Case No. 429 of 2024, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions
