1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 307, 506 and 34 of the Indian Penal Code & Section 27 of the Arms Act.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and has been falsely implicated in the instant case by the informant and the allegation of firing is against Shivam Singh, who is alleged to have fired causing injury on the chest of the brother of the informant and thereafter is alleged to have fled away from the place of occurrence along with the accused persons including the petitioner. It is next submitted that similarly situated co-accused Shashi Singh @ Shashi Ranjan Singh has been granted the privilege of anticipatory bail by a learned coordinate Bench of this Court by an order dated 14.03.2024 in Cr.

Patna High Court CR. MISC. No.17525 of 2024(2) dt.27-03-2024 2/2 Misc. No.14624/2024.

4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Aandar P.S. Case No.157/2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

6. Further, one of the bailors of the petitioner shall be his father namely Ram Kumar Singh.

7. It is also made clear that in the event if the learned trial court comes to a conclusion that the petitioner after his release on anticipatory bail is trying to delay the case in any manner, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner.
