Prayer is for grant of bail in Bhabua P.S. Case No. 184 of 2017 registered under sections 395 and 412 IPC. The informant was going to deposit the cash when at gunpoint he was looted in a lane.
Learned counsel for the petitioner submits that the petitioner is not named in the FIR. Subsequently, co-accused Sonu Pandey was arrested who disclosed the names of many including the petitioner. Nothing was recovered or found in possession of the petitioner who is languishing in jail custody since 07.05.2017. The charge sheet has already been filed. It is also submitted that co-accused Durga Singh @ Durga Singh Patel @ Durga Patel whose name also transpired in the
Patna High Court Cr.Misc. No.50817 of 2017(2) dt.09-11-2017 2/2 confessional statement of the co-accused Sonu Pandey has since been granted the privilege of bail in Cr. Misc. No. 47324 of 2017 having noticed that other accused persons having identical allegation were also granted bail. The petitioner has no criminal antecedents. It is stated that after his arrest in the present case he was remanded in two other cases. Similar was the case in respect of other co accuseds who have been granted bail.
Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-IV, Kaimur at Bhabua in S.Tr. No. 293/2017/318/2017 (arising out of Bhabua P.S. Case No. 184 of 2017) on condition that one of the bailors shall be his own/close family member. As soon as the charges are framed, he shall appear in person on each date fixed at the trial. In case of default in doing so on two consecutive dates, the trial court shall cancel his bail bonds and secure his arrest in accordance with law. (Kishore Kumar Mandal, J) HR/- U T
