JUSTICE ARUN KUMAR ORAL ORDER 15-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 5.4.2018, seeks bail in Katihar Mufasil PS Case No. 29 of 2018 registered under Sections 366A and 34 of the IPC.

Learned Counsel for the petitioner submits that it is a case of elopement, the girl herself eloped with the petitioner but later she returned back to her parents thereafter made statement against the petitioner but she has not alleged of any sexual exploitation, moreover the girl is major and has appeared in Intermediate examination.

Having considered the said facts and circumstances, the petitioner, namely, Md. Haidar @ Md. Haidar Ali is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri D.Singh, Judicial Magistrate, lst Class, Katihar in connection with Katihar Mufasil PS Case No. 29 of 2018.
