JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 06-07-2020 Heard the parties through the virtual court proceeding. The petitioner seeks bail in connection with Belchhi P.S. Case No. 67 of 2019 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 325, 307, 302 and 504 of the Indian Penal Code.
The prosecution case, in brief, as contained in the fardbeyan of informant, Pintu Kumar, is that on dated 02.11.2019 at about 9:00 A.M., he went along with tractor to plough his land at Gangti. In the meantime, Ram Pravesh Raut and others seventeen named accused persons including this petitioner has arrived there with arms and ammunitions and started abusing him and also stopped the ploughing work. His driver Guddu Kumar, fled away from there to left the tractor. Learned counsel for the petitioner submits that the

He further submits that the petitioner is member of mob and there is no specific allegation against the petitioner only general and vague allegation against the petitioner. He further submits that no such type of occurrence has been took place as mentioned in the F.I.R. and the petitioner is in jail custody since 04.11.2019. Learned A.P.P. for the State has opposed the prayer for bail and from perusal of the impugned order, the place of occurrence has mentioned in paragraph-5 of the case diary. The witnesses have fully supported the prosecution story. In the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner in connection with Belchhi P.S. Case No.67 of 2019 is hereby rejected. However, the petitioner may renew his prayer for bail after framing of charge. (Anjani Kumar Sharan, J) Nasimul/- U T
