The petitioner seeks regular bail in connection with Sasaram Nagar (Model) P.S.Case No.942 of 2016 dated 19.8.2016, registered for offences punishable under Section 379 of the Indian Penal Code.

The petitioner is not named in the F.I.R.

It has been submitted on behalf of the petitioner that in another case the petitioner has been arrested on the basis of confessional statement of the co-accused and he has been remanded in this case and he is in custody for 5 1⁄2 months and coaccused have been granted bail by co-ordinate Benches of this Court in Cr. Misc. No.22062 of 2017 vide order dated 8.5.2017 and Cr. Misc. No.25184 of 2017 vide order dated 29.5.2017 and Cr. Misc. No.11.7.2017, vide order dated 2527 of 2017.

Patna High Court Cr.Misc. No.35697 of 2017 (2) dt.09-08-2017 2/2 Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Rohtas at Sasaram in connection with Sasaram Nagar (Model) P.S.Case No.942 of 2016 dated 19.8.2016.

With following conditions :

(i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall co-operate in disposal of trial and make himself available as and when required by the court. In the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reason, his bail bond shall be cancelled.
