2. The instant application for anticipatory bail has been filed by the petitioner apprehending her arrest in connection with Kesariya P.S. Case no. 314 of 2024 instituted for the offence under Sections 318 (4), 338, 336(3), 340(2), 308(4), 351(2) and 352 of the Bharatiya Nyaya Sahnita, 2023.

3. The case of the prosecution is that the petitioner is one of the purchaser of the land has purchased through sale deed. It is alleged that this petitioner along with other coaccused persons, prepared a false document of the registered land of the informant and demanded a ransom of Rs. 50,00,000/- from the informant to give up their false claim and threatened the informant with dire consequences.

4. Learned counsel for the petitioner has submitted that petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that the

The land has not been sold by her rather she has purchased the land, in question. It is further submitted that similarly situated co-accused, namely, Irshad Aahmad @ Irshad Ahmad Khan has since been extended the privilege of bail vide order dated 20.03.2025 passed in Cr. Misc. No. 11421 of 2025.

5. Learned APP appearing for the State opposed the prayer of bail of the petitioner.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of her arrest or surrender in connection with Kesariya P.S. Case no. 314 of 2024, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
