JUSTICE JYOTI SARAN ORAL JUDGMENT Date: 14-02-2017 A detailed order has been passed by this Court as recorded on 24.1.2017 when this Court taking note of the prayer of the petitioner for quashing the order of the suspension had directed the State to inform the status of the disciplinary proceeding taking note of the previous round of litigation that has engaged the parties. It is following such direction that a second supplementary counter affidavit has been filed by the State and Mr. Ashish Kumar Lal A.C. to G.A.5 in reference to paragraph 7 of the second supplementary counter affidavit submits that the enquiry under the Bihar Government Servant (Classification, Control and Appeal) Rules, 2005 has since concluded and the enquiry report along with the second show cause has been served on the petitioner vide memo

Patna High Court CWJC No.7260 of 2016 dt.14-02-2017 2/2 No.9333 dated 25.1.2017 requiring him to file his reply within a fortnight from receipt thereof. It is thus submitted that no sooner reply is filed that final orders would be passed.

Having heard learned counsel for the parties and taking note of the sequence of events that has taken place in the present case as recorded in the order dated 24.1.2017 and considering the statement made in paragraph 7 of the second supplementary counter affidavit, I deem it fit and proper to dispose of the writ petition with an advise to the State Government to pass final orders on the disciplinary proceedings expeditiously and preferably within six weeks of the filing of the show cause reply by the petitioner. The writ petition is disposed of.
