====================================================== CORAM: HONOURABLE MR. JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-05-2020 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State through video conferencing.

Petitioner is in custody since 16.11.2019 and seeks bail in connection with Muffasil P. S. Case No.616 of 2018 registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

In huge quantity of countrymade foreign liquor was recovered from a pick-up van and the driver of the aforesaid pick-up van was arrested. The aforesaid driver disclosed the name of the petitioner claiming that the seized liquor belonged to the petitioner. However, it appears that except the

Patna High Court CR. MISC. No.14122 of 2020(2) dt.13-05-2020 2/2 confessional statement as well as criminal antecedent of the petitioner, there is nothing against him. The impugned order goes to show that the investigation against the petitioner has already been completed.

Considering the aforesaid facts and circumstances of the case as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IIcum-Special Judge, Begusarai in connection with Muffasil P. S. Case No.616 of 2018.

However, it is made clear that if the petitioner fails to make available sureties due to lockdown as well as due to prevailing situation, the concerned court shall release the petitioner provisionally on personal bond with condition that petitioner shall furnish the sureties when lockdown is over.
