JUSTICE SUDHIR SINGH ORAL ORDER 13-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 406, 420 and 120-B/34 of the Indian Penal Code.
The informant has alleged that accused Sanjay Kumar Sharma, Shatrudhan Kumar, Rajesh Kumar and Vijay Singh came together in his rice mill for the purpose of seeing the sample of rice. It is further alleged that on 19/20.02.2015 several calls were made to his company's mobile 8294849790 from mobile no. 8298250588, 8863897974 and 8409514745 respectively asking that on a draft, 15 tones rice be sent to them and after receiving the rice they will pay rest amount. It is further alleged that he sent 15 tones 25 kgs rice of Apple Brand in the name of BOT Agency. The rice was unloaded and informed the informant that on
Patna High Court Cr.Misc. No.22145 of 2015 (2) dt.13-07-2015 2/2 Monday he will send money but no payment was made. On behalf of the petitioner it has been submitted that there is no specific allegation against him. The petitioner has been made accused in the present case due to mistake of fact. It has further been submitted that the petitioner is ready to deposit an amount of Rs. 50,000/- before the court below, which shall be subject to final disposal of the case.
On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts, the above named petitioner is directed to deposit an amount of Rs. 50,000/- in the court below, which shall be subject to final disposal of the case and on doing so, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.,Begusarai, in connection with Begusarai Town P.S.Case No. 111/2015, subject to the conditions as laid down u/s 438(2) Cr.P.C.
