This is an application for grant of regular bail filed on behalf of the petitioners. Petitioners are in custody in connection with Rail Jhajha PS Case No.16 of 2019 for the alleged offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.
Allegation in the instant case is that total 40 liters of country-made liquor was sized. Learned counsel representing the petitioners submits that petitioners have no criminal antecedent and nothing was recovered from the conscious possession of the petitioners. Petitioners are in custody since

Considering the fact that petitioners have no criminal antecedent and they have remained in custody since 28.01.2019, this application is allowed. Accordingly, let the petitioners above-named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Addl. Sessions Judge -II-cum Special Court, Excise, Jamui in connection with Rail Jhajha PS Case No. 16 of 2019.
