Patna High Court CWJC No.8261 of 2015 (2) dt.11-04-2016 2/2 From perusal of the impugned order it appears that the court below relying upon the decision of the Supreme Court in the case of Paras Nath Rai - State of Bihar, AIR 2013 SC 1010, has held that the plaintiffs's suit for partition has abated in view of the provisions as contained under Section 4(b) and Section 4(c) of the Bihar Consolidation of Holdings and Prevention of Fragmentation Act, 1956. Therefore, the impugned order suffers from no jurisdictional error. Thus, the writ application is dismissed.
