The petitioner seeks bail in connection with Ghorasahan P.S. Case No. 95/2018 dated 11.03.2018 instituted for the offences under Section 414/34 of the Indian Penal Code read with Sections 25(1-b)a, 26 and 35 of the Arms Act. The petitioner is said to have been arrested with two country made pistols and one live cartridge.

The learned counsel for the petitioner has submitted that while he was witnessing a musical programme in his village, he was arrested by the police at the instance of somebody, with whom he had picked up fight at the show only. The evidence regarding recovery of the firearm weapons is only on paper and not in reality.

Patna High Court Cr.Misc. No.34570 of 2018 (3) dt.06-07-2018 2/2 The petitioner does not bear any criminal antecedent and he is in custody since 12.03.2018.

Considering the aforesaid facts, the petitioner above named is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Ghorasahan P.S. Case No. 95/2018.
