Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with K. Hat (Madhubani) P.S. Case No. 174 of 2018 registered under Sections 341, 323, 324 and 307/34 of the Indian Panel Code and Section 27 of the Arms Act.
The accusation is that in the morning of 20.03.2018, the informant was sitting at his door on the chair. At that time, four persons, named in the F.I.R., including the petitioner along with 12-14 unknown persons armed with weapons and country made pistols in their hands, came near the informant with an intention to
Patna High Court Cr.Misc. No.30436 of 2018 (2) dt.22-05-2018 2/3 kill him and, thereafter, Bikram Singh fired at the informant but the informant laid on the ground and saved himself. When Chaturanand, the brother of the informant, rushed to save the informant, the petitioner Rahul Sinha opened fire at him, which passed touching his head. Thereafter, all the accused persons caused injury to the informant and his brother through butt of the pistol and rod.
Learned counsel for the petitioner submits that while there is allegation against four persons including the petitioner to have caused injury to the informant and his brother but only two injuries were found on the person of the informant and out of the two injuries, one is simple in nature, while another injury, which is lacerated wound on head of the size of 11 1⁄2" x 1⁄2" x 1/2" and mild swelling on the right side TM joint, was found grievous in nature. The petitioner has no criminal antecedent.
It is further submitted that co-accused have been granted bail by this Court by order dated 10.05.2018 in Cr. Misc. No.29157 of 2018 order dated 14.05.2018 passed in Cr. Misc. No.29060 of 2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees Ten thousand)
Patna High Court Cr.Misc. No.30436 of 2018 (2) dt.22-05-2018 3/3 with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with K. Hat (Madhubani) P.S. Case No. 174 of 2018.
