Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Tekari P.S. Case No. 231 of 2022 dated 28.04.2022 lodged under Sections 363 and 366(A) of the I.P.C.

As per prosecution case, the allegation made against the present petitioner is that he has kidnapped the victim (daughter of the informant).

Learned counsel for the petitioner submits that the alleged victim has been recovered during investigation and her statement was recorded under Section 164 of Cr.P.C. which is Annexure-2. From the statement of 164 of Cr.P.C. which the

Patna High Court CR. MISC. No.16567 of 2023(2) dt.10-05-2023 2/2 victim has alleged before the Court there was nothing against the present petitioner. Learned counsel for the petitioner further submits that petitioner is in custody since 04.06.2022 having clean antecedent.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate VI, Gaya in connection with Tekari P.S. Case No. 231 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C..

With this observation, the bail application stands allowed.
