The petitioner seeks bail in K. Nagar P.S. Case No. 37 of 2017 arising out of CIS No. 505 of 2017 registered under Sections 341, 323, 324, 307, 379 and 504/34 of the Indian Penal Code.

Over row of grazing the field of the informant by the cow of the accused persons, the petitioner and others are said to have assaulted the informant and his father by mans of iron rod and Dabiya. Specific allegation against the petitioner is of assaulting on the head of the father of the informant by means of Dabiya.

It is submitted by learned counsel for the petitioner that all the allegations levelled against the petitioner are general

Patna High Court Cr.Misc. No.38094 of 2017 (2) dt.10-08-2017 2/2 and omnibus in nature barring assaulting on the head of the father of the informant by means of dabiya. So far as allegation of assaulting on the head of the father of the informant is concerned, the doctor has found the head injuries of the victim as simple in nature caused by hard and blunt substance. The petitioner has been languishing in custody since 12.06.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with K. Nagar P.S. Case No. 37 of 2017 arising out of CIS No. 505 of 2017.
