Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and Section 3⁄4 of the Explosive Substances Act.

On information that miscreants are preparing to commit dacoity, raid was laid when one Pradip Kumar Das was apprehended with some explosives who suggested the name of Girija Nandan Das and said Girija Nandan Das suggested the names of five miscreants including the petitioner. It is submitted by learned counsel for the petitioner that except confession of the co-accused, there is nothing on record to suggest the complicity of the petitioner. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

No.22230 of 2015 (2) dt.07-07-2015 2/2 The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Banka P.S. Case No. 164 of 2012, pending in the Court of learned Chief Judicial Magistrate, Banka.

With the observations above, the application stands disposed off.
