The petitioners herein seek anticipatory bail in Gopalpur P.S. Case No. 14 of 2016, registered under Sections 147, 148, 149, 447, 341, 323, 307 of the Indian Penal Code. Land dispute is the genesis of the occurrence. It is alleged that both the petitioners fired from the gun at the informant but not received any injury. The petitioners have claimed no criminal antecedents. The counter version of the occurrence is Annexure-2, an FIR lodged under Section 307 of the Indian Penal Code by petitioner no. 2 Considering the genesis of the case and the fact that there is a counter version lodged by the petitioner no. 2 as also no one
Patna High Court Cr.Misc. No.17373 of 2016 (2) dt.09-05-2016 2/2 received any injury, I am persuaded to extend the privilege of anticipatory bail, let the petitioners above named, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate Bettiah in Gopalpur P.S. Case No. 14/2016 on condition that one of the bailors shall be his/their own/close family member. The petitioner shall appear on each date fixed at the trial. In case of default in appearance on two consecutive dates, the trial court shall have liberty to cancel their bail bonds.
