JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in connection with Excise Case No. 24 of 2020, registered under Section 30(ka) and 56(kha) of the Bihar Prohibition and Excise Act, 2018.

The accusation is that in course of patrolling duty for checking the preparation and sale of illicit liquor, the informant/complainant and other Excise personnel saw a motorcycle coming towards Jharkhand side. On seeing the complainant and other excise officials, the person boarding on the motorcycle fled away leaving the motorcycle. On search of motorcycle, 08 bottles, each containing 750 ML, Indian made

Patna High Court CR. MISC. No.13932 of 2020(2) dt.11-06-2020 2/2 foreign liquor and 12 bottles, each containing 500 ML beer recovered from the motorcycle.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that petitioner has not been apprehended on the spot. Further submission is that petitioner has no criminal antecedent and he is also not the owner or driver of the motorcycle from which the alleged liquor is said to be recovered.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise), Gaya in connection with Excise Case No. 24 of 2020, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
