BAJANTHRI ORAL JUDGMENT Date : 12-05-2022 Service of notice to Respondent No. 7- Asha Rani stands dispensed, since no adverse order is being passed against her. Heard learned counsel for the respective parties. In the instant petition, petitioner has prayed for the following reliefs:

(i) For issuance of writ in the nature of certiorari for quashing of order dated 16.3.2020 passed by District Programme Officer, Saharsa in

Patna High Court CWJC No.7795 of 2021 dt.12-05-2022 2/3 Anganwari Appeal case no. 164/184/2019 whereby selection of petitioner as Anganwari Sevika at Anganwari centre Bangama centre code 122 has been cancelled and by that order it was directed to issue selection letter to Respondent No.7 namely Asha Rani for the post of Anganwari Sevika.

(ii) For issuance of writ in the nature of Mandamus direction to Respondents to reinstate the petitioner for working as Anganwari Sevika at Anganwari centre, Bangama, centre code 122 in the district of Saharsa.

The matter relates to selection and appointment to the post of Anganwari Sevika in Anganwari Gram Panchayat Situaha in Salkhua Block, ward no. 8, Anganwari Kendra No.-122. The petitioner and 7th respondent are the candidates for the selection and appointment to the post of Anganwari Sevika for the aforesaid centre. The petitioner feeling aggrieved by the selection and appointment of the 7th respondent preferred a Anganwari Appeal No. 22/2020 dated 24.06.2020 before the District Magistrate, Saharsa and it is pending consideration. Therefore, the appellate authority is hereby directed to decide the petitioner's appeal dated 24.06.2020 within a period of three months from the date of receipt of this order after giving opportunity of hearing to the 7th respondent Asha Rani and communicate the decision to the respective parties.
