JUSTICE MADHURESH PRASAD ORAL JUDGMENT Date : 25-02-2019 Petitioner was the 3rd empanelled candidate in the process of selection for appointment as Anganbari Sevika at Center Anusuchit Jati Tola, Niranjanpur Centre, Panchayat Kanjharua. It is submitted that first empanelled candidate had submitted false/forged testimonials in support of his candidature. The petitioner has raised the issue before the District Magistrate, Buxar.
Counter affidavit has been filed wherein it is stated that the issue is being inquired and unless the verification report regarding the testimonials submitted by the selected candidates
Patna High Court CWJC No.12052 of 2014 dt.25-02-2019 2/2 is examined, honorarium would not be paid to the selected candidates.
It is also stated by the respondents in the counter affidavit that the issue will be properly inquired and action in accordance with law would be taken. Counter affidavit has been filed after serving copy on petitioner's counsel in September, 2015. Neither the petitioner nor the respondent State is in a position to inform this Court what has been fate of the exercise undertaken for verification. If no final decision has been taken by the respondents pursuant to the allegation made by the petitioner then this Court would observe that the final decision should be taken by the District Magistrate, Buxar, respondent no. 3 expeditiously and preferably within a period of three months from the date of receipt/production of a copy of this order in accordance with law and after hearing the parties concerned by a reasoned and speaking order.
