The petitioner seeks regular bail in connection with Katihar Rail P.S. Case No. 04 of 2018 for the offences punishable under Section(s) 401/34 of the Indian Penal Code and Section 137, 147 of Railway Act, 1989.

The allegation is regarding recovery of two bottles, cash of Rs.100/- from the possession of petitioner herein. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is further submitted that the petitioner has a clean antecedent and is languishing in custody since 29.01.2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on

Patna High Court Cr.Misc. No.31701 of 2018 (2) dt.31-05-2018 2/2 furnishing bail bonds of Rs.10,000/- (rupees Ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Katihar in connection with Katihar Rail P.S. Case No. 04 of 2018.
