The petitioners seek regular bail in connection with Sono P.S.Case No.155 of 2017 registered for offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 30(a), 41 and 47 of the Bihar Prohibition and Excise Act, 2016. Allegation against the petitioners is about recovery of 200 ltrs. of liquor from a Maruti Vehicle.
Submission of the learned counsel for the petitioners is that nothing has been recovered from the conscious possession of the petitioners. They have remained in custody since 24.7.2017. Heard learned A.P.P. also.
Having heard both sides and in view of allegation,
Patna High Court Cr.Misc. No.44217 of 2017 (2) dt.15-09-2017 this application is disposed of with direction that once the charge is framed in this case or they remain in judicial custody for one more month, the learned court below shall release the petitioners in connection with Sono P.S.Case no.155 of 2017. With the aforesaid observation, this application is disposed of.
