JUSTICE SANJAY KUMAR ORAL ORDER 05-07-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks regular bail in connection with S. Kamal P.S. Case No. 32/2018 registered for an offence punishable under section 395 of the Indian Penal Code. The learned counsel for the petitioner submits that this petitioner along with Manish Kumar while moving in a 'Safari' vehicle was apprehended by police, but nothing has been recovered from the possession of the petitioner or co-accused. The petitioner is in custody since 22.02.2018 having clean antecedent. He has not been put on TIP till date. The said Manish Kumar has been allowed bail by one of the coordinate Bench of this Court in Cr. Misc. No. 32477/2018. The case of the petitioner

Patna High Court Cr.Misc. No.30785 of 2018 (3) dt.05-07-2018 2/2 stands of similar footing and so he deserves to be enlarged on bail.

The learned Additional Public Prosecutor on the other hand opposed the submission.

Considering the facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with S. Kamal P.S. Case No. 32/2018, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
