The present application has been filed for modification of the order dated 01.04.2022 passed in Cr. Misc. No. 68102 of 2021 to the extent of extending the period of surrender.

Learned counsel for the petitioner submits that this Court vide order dated 01.04.2022 passed in Cr. Misc. No. 68102 of 2021, granted anticipatory bail to the petitioner with a condition to deposit Rs. 5 lakhs in Juvenile Justice Fund. The bail bonds of the petitioner were to be accepted in the event of his arrest/surrender before the learned court below within a period of six weeks from the date of order. Subsequently, against the condition of deposit of Rs. 5 lakhs imposed, the petitioner moved before the Supreme Court and the Supreme

Patna High Court CR. MISC. No.20577 of 2023(2) dt.13-04-2023 2/2 Court, vide order dated 16th September, 2022 passed in Cr. Appeal No. 1588 of 2022 (Arising out of SLP [Criminal] No. 7420 of 2022 set aside the order of this Court with regard to condition of depositing of Rs. 5 lakhs, however the order of this Court in all other respects was directed to be sustained. It is further submitted that since the petitioner moved before the Supreme Court, hence he could not surrender before the learned court below within the stipulated period of six weeks. Hence, the present application.

On the grounds mentioned in the modification application, the period of surrender is extended by four weeks from the date of receipt/production of a copy of this order after depositing Rs. 2000/- in the victim compensation fund in connection with Mairwa P.S. Case No. 53 of 2019 pending in the court of learned Additional Sessions Judge 2nd cum Special Judge (Excise Act), Siwan.

The order dated 01.04.2022 is modified to the extent as indicated above.

Accordingly, the present application stands disposed of.
